Empress Announces Nuclear Doctrine to Ease International Concerns

Athens – Following both internal and external concerns regarding the escalation of warfare with the introduction of nuclear weapons, the Empress has requested a committee of experts to investigate the matter over the past few weeks. The findings of this committee were relayed to the Crown last week and today Empress Athanasia has issued the Imperial Proclamation on the Use of Nuclear Weapons by the Hellenic Forces and Any Element of the Athenian Federation and the Control of Nuclear Technology. The doctrine, which due to the timing of its release and nature of its contents has already being referred to as the Valentine Doctrine, imposes strict conditions on any use of nuclear weapons and restricts such usage to situations where there is no other conventional method of achieving the security and existence of the Athenian Federation. Imperial Proclamations under the constitution of the Athenian Federation hold the status of a full law and a formal order has followed the Imperial Proclamation with the same content from the Empress’ capacity as Commander-in-Chief of the Hellenic Forces.

The Imperial Proclamation has been well received by all sides of the political spectrum, even opponents of nuclear weapons. “We remain opposed to Athenian ownership of nuclear weapons. While I have no doubt our people are more than capable of handling them, our mere ownership invites other countries to follow our lead and will make the world less safe. However, as long as there is a parliamentary majority in favour of them and the Empress has full control on all military and diplomatic matters, I can recognise that this doctrine will reassure the world of our peaceful intentions and ease concerns of our neighbours.” Michail Papoutsis, leader of the Green Party responded. Alexandros Aristotelis Spiros, a representative for the Socialist Alliance from Byzantion, spoke for the proponents of nuclear weapons when he stated that “The security of the Athenian Federation is our greatest concern. While having the gun to deter any of our enemies is essential for our security, no one wants to use these weapons. By establishing clear and fair rules we can make sure we aren’t perceived as some rogue state while simultaneously setting an example for any would-be nuclear power.

The doctrine has been added in full at the bottom of this article, however to summarize. Under the Valentine Doctrine the decision to launch nuclear weapons must always come from the Empress, a successor in case of death or if the complete continuity of government program fails an automated failsafe protocol. Furthermore, a two-person verification system must be in place at each chain on the nuclear triad and any actual action to launch may not occur unless both persons have verified the order is legitimate. Beyond the technical on launch authorization, the doctrine also establishes that the Athenian Federation will only use nuclear weapons in a tactical capacity if a hostile force threatens to overwhelm the integrity of Athenian territory and if the Hellenic Forces have no other conventional capability to halt the foreign invasion. It explicitly does not authorize strategic use of nuclear weapons under these conditions and also explicitly does not allow for the use of nuclear weapons in a tactical capacity to support Hellenic Forces in enemy or even allied territory. The strategic use of nuclear weapons will only be done if the Athenian Federation has been attacked by strategic nuclear weapons in a first strike and if such a strategic strike can decapitate an enemy command structure. In practice this means that only enemy sites home to significant government and military presences may be attacked. Finally, the export of nuclear weapons technology and knowledge is strictly prohibited in line with the principles of non-proliferation.

Some critics among the most hardcore supporters of nuclear weapons have pointed out that the highly restrictive doctrine will invite foreign governments to operate just short of the red line to inflict devastating blows against the Athenian Federation in the safety of knowing that Athens will not respond with nuclear force. These critics have also stated that the Empress as a civilian is forcing the military to fight with one hand and one leg tied behind their back. Both criticisms have been dismissed by a spokesperson for the Crown, stating that the use of nuclear weapons is such an extreme measure that only must be done if there truly is no other way and if it actually serves to obtain a military objective. She went on to state that retalliatory strikes out of revenge or campaigns of terror are not the Athenian way and that Athens will always fight with honour.

Imperial Proclamation on the Use of Nuclear Weapons by the Hellenic Forces and Any Element of the Athenian Federation and the control of Nuclear Technology

On this 14th of February in the year 2100. I, Empress Athanasia of the Athenian Federation, Queen of Macedon, Lady Protector of the Spartan League, Chosen of the Amazonian Free State, Speaker of Zeus, Avatar of Athena, do hereby proclaim the following.

Nuclear Weapons constitute a paradigm shift in the manner and consequences of warfare. This paradigm shift requires great care and responsibility by and from those states that maintain nuclear power. To establish clear rules for the manner of operation of nuclear weapons and the situations in which they may be used I will seek to avoid impacts on global stability that may normally follow the introduction of such power in the world.

Definitions:
Tactical Use: Tactical use is the use of nuclear weapons against military targets to directly obtain a military directive. These attacks will use smaller yield weapons and highly precise delivery mechanisms to avoid collateral damage.
Strategic Use: Strategic use is the use of nuclear weapons against military and civilian targets to obtain a larger strategic objective, such as the surrender of a combatant, the elimination of leadership or to halt an invasion.
First Strike: The initial launch of nuclear weapons.
Second Strike: The launch of nuclear weapons in response to a first strike.

Organizations Allowed to Operate Nuclear Weapons:
Within the Athenian Federation no organization may operate or maintain nuclear weapons except for the Hellenic Air Force, the Hellenic Navy and the Hellenic Space Force. Operating or maintaining nuclear weapons by any other party may be prosecuted as treason and punished in accordance with article 208 of the Imperial Criminal Code. Use of nuclear weapons by any other party may be prosecuted as high treason and punished in accordance with article 207 of the Imperial Criminal Code, each resulting fatality may be prosecuted as murder and punished in accordance with article 594 of the Imperial Criminal Code, each resulting non-fatal casualty may be prosecuted as attempted murder and punished in accordance with article 595 of the Imperial Criminal Code and any other form of damage may be prosecuted and punished in accordance with the most applicable article of the Imperial Criminal Code.

Government Officials Empowered to Order the Launch of Nuclear Weapons:
Any order to launch nuclear weapons must be issued by the Empress of the Athenian Federation or if incapacitated her legal successor in line with the Constitution of the Athenian Federation. The Empress of the Athenian Federation may delegate the authority to launch nuclear weapons for tactical purposes to General or Flag Officers. If such authority is delegated the Empress must issue strict parameters within which the Officer is authorized to use tactical nuclear weapons. Falsifying orders to launch nuclear weapons may be prosecuted as treason and punished in accordance with article 22 of the Hellenic Forces Code of Justice or article 208 of the Imperial Criminal Code, each resulting fatality may be prosecuted as murder and punished in accordance with article 110 of the Hellenic Forces Code of Justice or article 594 of the Imperial Criminal Code, each resulting non-fatal casualty may be prosecuted as attempted murder and punished in accordance with article 111 of the Hellenic Forces Code of Justice or article 595 of the Imperial Criminal Code and any other form of damage may be prosecuted and punished in accordance with the most applicable article of the Hellenic Forces Code of Justice or Imperial Criminal Code.

On the Manner of Operation:
The impact and consequences of nuclear attacks require a much greater than usual care to authenticate orders as legitimate and originating from those with the legal authority. To achieve this the following requirements are issued on all nuclear weapons in use by the Hellenic Air Force, Hellenic Navy and Hellenic Space Force.
1. Safeguards must be installed on all nuclear warheads, delivery systems and delivery vehicles to prevent accidental or unauthorized launch and detonation, as well as remote dismantlement in case of loss or theft.
2. Following the issuance of a launch authorization order by the Empress of the Athenian Federation or a designated successor, the Magistrate of Defence or a designated successor must confirm the order has been issued by the legal authority.
3. After the confirmed launch authorization order has been directed to the applicable units two officers ranked at least O-5 must verify the order using the applicable verification mechanism. Safeguards must be in place to guarantee that under no circumstance a person can bypass two-person verification.

Confirmation and authentication may only be done to verify a launch authorization order. Neither the Magistrate of Defence or a designated successor or any member of the Hellenic Air Force, Hellenic Navy or Hellenic Space Force may refuse to execute a legal launch authorization order. Refusing to execute a legal launch authorization order may be prosecuted as insubordination and punished in accordance with article 596 of the Imperial Criminal Code for government officials or article 101 of the Hellenic Forces Code of Justice. If the refusal to launch compromises Athenian Security it may additionally be prosecuted as high treason and punished in accordance with article 110 of the Hellenic Forces Code of Justice or article 207 of the Imperial Criminal Code.

Launching nuclear weapons without a confirmed launch authorization order may be prosecuted as high treason and punished in accordance with article 110 of the Hellenic Forces Code of Justice or article 207 of the Imperial Criminal Code, each resulting fatality may be prosecuted as murder and punished in accordance with article 110 of the Hellenic Forces Code of Justice or article 594 of the Imperial Criminal Code, each resulting non-fatal casualty may be prosecuted as attempted murder and punished in accordance with article 111 of the Hellenic Forces Code of Justice or article 595 of the Imperial Criminal Code and any other form of damage may be prosecuted and punished in accordance with the most applicable article of the Hellenic Forces Code of Justice or Imperial Criminal Code.

The Hellenic Space Force must maintain an automated authentication measure for the legal authority to maintain in constant contact with all elements of the nuclear infrastructure. If at any time communication is lost for a duration of time longer than provided for in the standing order on nuclear launches operators of nuclear weapons must execute preset orders. The Empress of the Athenian Federation or a designated successor will provide individual orders for each Ballistic Missile Submarine Commanding Officer, Nuclear Missile Battalion Commanding Officer, Bomber Wing Commander or any future Commanding Officer of a unit provided with nuclear weapons. These orders must be sealed until the aforementioned failsafe is initiated and provide clear orders on how the recipients are to proceed.

On the Use of Nuclear Weapons in a Strategic Capacity:
The Athenian Federation will not use nuclear weapons for strategic purposes unless in a second strike capacity. Strategic nuclear first strikes are prohibited. The Athenian Federation will only launch a second strike against targets that serve to reduce the threat an enemy government or military can pose against the Athenian Federation and its territorial integrity.

On the Use of Nuclear Weapons in a Tactical Capacity:
The Athenian Federation may use nuclear weapons in a tactical first strike capacity. It will only do so if an enemy power threatens to compromise the integrity of Athenian territory and if there is no other conventional method to prevent or fight the incursion. The Athanian Federation will not use nuclear weapons in a tactical first strike capacity to support an invasion by Hellenic or allied forces against another country.

On the Export of Nuclear Weapons Technology and Knowledge:
The Athenian Federation will not export nuclear weapons technology and knowledge to any state, other sovereign entity, group or individual. Parties contracted by the Athenian Federation to produce nuclear weapons must restrict knowledge to only those that absolutely need it and take all possible precautions against theft or loss of technology or knowledge. Illegally exporting nuclear weapons technology and knowledge or aiding in these efforts may be prosecuted as high treason and punished in accordance with article 110 of the Hellenic Forces Code of Justice or article 207 of the Imperial Criminal Code.
